One juror, Wolford, had indicated in the earlier trial a strong credibility prejudice favoring police testimony, and he had been excused. The defense challenged Wolford for cause in this case, but he was not excused, and the defense used a peremptory challenge to remove him. Suarez was convicted and appealed.
